Obligatory e-invoicing in Poland from 1 January 2023 – approval European Commission

The European Commission agrees that Poland is allowed to use universal electronic invoicing.
Entrepreneurs will soon face with the next stage of the digital revolution.

The National System of Electronic Invoices (KSeF) is the next step in the implementation of innovative services facilitating payments and settlements between companies, which are intended to ensure their security. Innovative solutions are aimed at contributing to a greater identification of tax fraud and facilitating the process related to the circulation of invoices.

On March 30, 2022, the Ministry of Finance informed that the European Union, in response to a request for a derogation submitted in August 2021, accepted the obligatory solution proposed by Poland in the use of electronic invoices. It should be noted that from January 1, 2022, taxpayers have the option to issue structured invoices using the National System of e-Invoices. At the moment, the use of structured invoices in the FSC is voluntary. However, the Ministry of Finance is already working on the business and legal concept of the target structure of the National e-Invoice System.

In practice, the KSeF system means a change in the process of issuing and receiving invoices. Structured invoices are prepared in accordance with the scheme developed by the Ministry of Finance – similar to the case of JPK_V7 files. After being issued, the e-invoice is sent from the financial and accounting system of the company via an interface (API) to the central base of the Ministry of Finance, i.e. KSeF, and then it is available in this system and can be downloaded by the contractor.

 

What are the advantages of opting for electronic invoicing?

E-invoice is presented as a digital revolution, which is expected to bring a number of benefits for entrepreneurs. The Ministry of Finance announces that the implementation of new solutions will translate into:

  • Cost reduction – invoices are stored and archived in the KSeF system for 10 years, there is no need to store invoices in separate IT systems of entrepreneurs.
  • Improving business transactions – introducing a single invoice standard: replacing paper and electronic documents (PDF) with digital data = digitization and automation of the circulation of invoices between taxpayers and the booking of invoices with taxpayers.
  • Increasing the speed of data exchange in contacts between contractors and mutual settlements – the issued invoice will be made available to the recipient practically in real time, which will affect the automation of accounting processes.
  • No duplicate invoices – it is not possible to lose or destroy an invoice.
  • Insight into the invoice circulation path – certainty that it has reached the contractor, constant availability of the contractor to invoices in the KSeF system.
  • Increasing the tax security of buyers of goods or services.
  • One fixed invoice format with the data arranged in the order specified in the invoice template – reducing mistakes in manual data entry and saving time for company employees.
  • Issuing structured invoices entitles the taxpayer to refund VAT in a 1/3 period shortened – from 60 to 40 days.
  • Simplification of the settlement of structured corrective invoices in minus: at the issuer at the time of issuing it, and at the buyer, if he agrees to receive electronic invoices – at the moment of its receipt at the Polish Financial Supervision Authority.
  • The entrepreneur issuing invoices in the KSeF does not have to send, at the request of the tax authorities, the structure of the Uniform Control File for Invoices (JPK_FA). These data are automatically available to the administration in the KSeF.

Obowiązkowa e-faktura w Polsce od 2023 roku – zgoda Komisji Europejskiej

Komisja Europejska zgadza się, by Polska stosowała powszechne fakturowanie elektroniczne.
Niedługo przedsiębiorców czeka kolejny etap cyfrowej rewolucji.

 Krajowy System Faktur Elektronicznych (KSeF) to kolejny krok we wdrażaniu innowacyjnych usług ułatwiających dokonywanie płatności oraz rozliczeń pomiędzy firmami, które w założeniu mają zapewnić im bezpieczeństwo. Innowacyjne rozwiązania mają na celu przyczynić się do większej identyfikacji oszustw podatkowych oraz ułatwić proces związany z obiegiem faktur.

Ministerstwo Finansów w dniu 30.03.2022 poinformowało, że Unia Europejska w odpowiedzi na wniosek o derogację złożony w sierpniu 2021 r. zaakceptowała proponowane przez Polskę obligatoryjne rozwiązanie w zakresie stosowania faktur elektronicznych. Należy zauważyć, że od 1 stycznia 2022 r. podatnicy mają możliwość wystawiania faktur ustrukturyzowanych z wykorzystaniem Krajowego Systemu e-Faktur. Na ten moment korzystanie z faktur ustrukturyzowanych w KSeF jest dobrowolne. Z kolei w Ministerstwie Finansów trwają prace nad koncepcją biznesową i prawną docelowej konstrukcji Krajowego Systemu e-Faktur.

W praktyce system KSeF oznacza zmianę procesu wystawiania oraz odbierania faktur. Faktury ustrukturyzowane są sporządzane zgodnie z opracowanym przez Ministerstwo Finansów schematem – podobnie jak ma to miejsce w przypadku plików JPK_V7. E-faktura po wystawieniu jest przesyłana z systemu finansowo-księgowego za pośrednictwem interfejsu (API) do centralnej bazy MF tj. KSeF, po czym jest dostępna w tym systemie i możliwa do pobrania przez kontrahenta.

 

Jakie są korzyści ze stosowania e-faktur?

E-faktura jest przedstawiana jako rewolucja cyfrowa, która ma wiązać się z szeregiem korzyści dla przedsiębiorców. MF zapowiada, że wdrożenie nowych rozwiązań będzie miało przełożenie na:

  • Zmniejszenie kosztów – faktury są przechowywane i archiwizowane w systemie KSeF przez 10 lat, nie ma konieczności przechowywania faktur w odrębnych systemach IT przedsiębiorców.
  • Usprawnienie obrotu gospodarczego – wprowadzenie jednego standardu faktury: zamiana dokumentów papierowych i elektronicznych (PDF) na dane cyfrowe = cyfryzacja i automatyzacja obiegu faktur między podatnikami oraz księgowania faktur u podatników.
  • Zwiększenie szybkości wymiany danych w kontaktach między kontrahentami oraz wzajemnych rozliczeń – wystawiona faktura będzie udostępniona odbiorcy praktycznie w czasie rzeczywistym, co wpłynie na automatyzację procesów księgowych.
  • Brak duplikatu faktur – nie ma możliwość zagubienia lub zniszczenia faktury.
  • Wgląd w ścieżkę obiegu faktury – pewność, że dotarła do kontrahenta, stała dostępność kontrahenta do faktur w systemie KSeF.
  • Zwiększenie bezpieczeństwa podatkowego nabywców towarów lub usług.
  • Jeden stały format faktury z danymi ułożonymi w porządku określonym we wzorze faktury – zredukowanie pomyłek przy ręcznym wprowadzaniu danych oraz oszczędność czasu pracowników firm.
  • Wystawianie faktur ustrukturyzowanych uprawnia podatnika do zwrotu VAT w skróconym o 1/3 terminie – z 60 do 40 dni.
  • Uproszczenie rozliczania faktur ustrukturyzowanych korygujących in minus: u wystawcy z chwilą jej wystawienia, a u nabywcy, jeśli wyrazi zgodę na otrzymywanie faktur elektronicznych – z chwilą jej otrzymania w KSeF.
  • Przedsiębiorca wystawiający faktury w KSeF nie musi przesyłać na żądanie organów podatkowych struktury Jednolitego Pliku Kontrolnego dla Faktur (JPK_FA). Dane te są automatycznie dostępne dla administracji w KSeF.
