New regulations for SLIM VAT 3

Ministry of Finance announced a Draft act amending the VAT Act and some other acts – the so-called SLIM VAT 3 (“Draft”). According to the justification of the Ministry of Finance, the SLIM VAT 3 project aims to simplify the regulations on settlements made by VAT payers – the same as it was in the case of SLIM VAT 1 and SLIM VAT 2. According to the Draft, with some exceptions, the new the regulations will apply from January 1, 2023. Consultations on the project will last until August 26, 2022.

Main assumptions of SLIM VAT 3:

  • Increasing the sales threshold for a small taxpayer – Currently, pursuant to Art. 2 point 25 letter a of the VAT Act, a small taxpayer is a taxpayer whose gross sales value does not exceed EUR 1,200,000. SLIM VAT 3 provides for an increase in the gross sales limit for a small taxpayer from EUR 1,200,000 to EUR 2,000,000, which will allow a wider group of entities to use the cash method and quarterly VAT settlements;
  • The exchange rate for correction invoices (collective correction invoices) – Currently, there are no regulations governing the rate to be used when issuing a correction invoice if the original invoice was issued in a foreign currency. Pursuant to the Draft, the legislator will sanction the use of the primary exchange rate both for “in plus” and “in minus” adjustments. In the case of collective corrections, the Draft assumes the use of the average NBP / ECB exchange rate from the last working day preceding the issuance of the collective correction invoice;
  • CJEU judgment in case C-935/19 – According to the Draft, the sanction will be applied by the tax authorities on an individual basis, depending on the taxpayer’s failure. Thus, the authority will impose an additional obligation of up to 30%, up to 20% and up to 15%, respectively;
  • Amendments to Binding Rate Information – SLIM VAT 3 plans to consolidate the issuing authority for Binding Rate Information (WIS), Binding Excise Information (WIA) and Binding Tariff Information (BTI). The body that will issue them is to be only the Director of the National Tax Information (Dyrektor Krajowej Informacji Skarbowej);
  • Change of the premises for VAT deduction in VAT – In the current legal status, the taxpayer must check whether he has received an invoice documenting VAT. In the case of its absence, after 3 months, it is obliged to correct the previously reported input tax. After the changes, the only condition for deducting VAT in the case of intra-Community acquisition of goods would be to show the VAT due (only the condition provided for in Article 86 (10b) (2) (b) of the VAT Act);
  • No obligation to issue both an advance invoice and a final invoice if the events took place in the same settlement period – Pursuant to the applicable regulations, the taxpayer is obliged to invoice received advance payments, deliveries or services rendered. The provisions do not regulate how a taxpayer who received an advance payment and performed a service in the same month is to do.
    As part of the SLIM VAT package 3, it is proposed to introduce provisions that in such cases will allow not to issue an advance invoice (then the final invoice should indicate the date of receipt of the advance);
  • VAT account – according to the Draft, the funds collected on the VAT account may be used to settle liabilities in the field of minerals tax, retail sales tax, and charges on foodstuffs (the so-called sugar fee).
  • No obligation to print fiscal reports – the taxpayer will not be obliged to print fiscal reports or other non-fiscal documents. This provision will only apply to taxpayers who record sales using an online cash register or virtual type online cash registers;
  • Extension of the subjective scope of the VAT exemption for investment fund management services – Pursuant to Art. 43 sec. 1 point 12 letter a of the VAT Act, currently, the services of managing investment funds based in Poland are exempt from VAT. It is proposed that this exemption could also apply to fund management services based in other European Union countries.

 


 

Ministerstwo Finansów ogłosiło projekt ustawy zmieniającej ustawę o VAT i niektóre inne ustawy – tzw. SLIM VAT 3. Zgodnie z uzasadnieniem MF projekt SLIM VAT 3 ma na celu uproszczenie regulacji dot. rozliczeń dokonywanych przez podatników VAT – tak samo jak miało to miejsce w przypadku SLIM VAT 1 oraz SLIM VAT 2. Zgodnie z projektem, z pewnymi wyjątkami, nowe przepisy będą obowiązywać od 1 stycznia 2023 r. Konsultacje projektu potrwają do 26 sierpnia 2022 r.

Główne założenia SLIM VAT 3:

  • Podwyższenie progu sprzedaży dla małego podatnika – Obecnie na podstawie art. 2 pkt 25 lit. a ustawy o VAT, małym podatnikiem jest podatnik, u którego wartość sprzedaży brutto nie przekroczyła 1 200 000 euro. SLIM VAT 3 przewiduje zwiększenia limitu sprzedaży brutto u małego podatnika z kwoty 1 200 000 euro do kwoty 2 000 000 euro, co pozwoli szerszej grupie podmiotów stosować metodę kasową oraz kwartale rozliczenia w VAT;
  • Kurs przeliczeniowy dla faktur korygujących (faktury zbiorcze) – Obecnie nie ma żadnych przepisów, które by regulowały, jaki kurs należy zastosować przy wystawieniu faktury korygującej, jeżeli pierwotna faktura została wystawiona w walucie obcej. Zgodnie z projektem Ustawodawca usankcjonuje stosowanie kursu pierwotnego zarówno przy korektach „in plus” jak „in minus”. W przypadku korekt zbiorczych projekt zakłada stosowanie kursu średniego NBP/EBC z ostatniego dnia roboczego poprzedzającego wystawienie zbiorczej faktury korygującej;
  • Wyroku TSUE w sprawie C-935/19 – Zgodnie z projektem sankcja będzie stosowana przez organy w sposób zindywidualizowany w zależności od uchybienia podatnika. Tym samym organ będzie wymierzał dodatkowe zobowiązanie w wymiarze odpowiednio do 30%, do 20% oraz do 15%;
  • Zmiany dotyczące wiążących informacji stawkowych – W ramach przedmiotowego projektu planowana jest konsolidacja organu wydającego wiążące informacje stawkowe (WIS), wiążące informacje akcyzowe (WIA) oraz wiążące informacje taryfowe (WIT). Organem, który będzie je wydawał, ma być wyłącznie Dyrektor Krajowej Informacji Skarbowej;
  • Zmiana przesłanek do odliczenia VAT przy WNT – W obecnym stanie prawnym podatnik musi kontrolować, czy otrzymał fakturę dokumentującą WNT. W przypadku jej braku po upływie 3 miesięcy jest obowiązany do korekty wcześniej wykazanego podatku naliczonego. Po zmianach jedyną przesłanką do odliczenia VAT w przypadku WNT miałoby być wykazanie podatku należnego z tytułu WNT (wyłącznie warunek przewidziany w art. 86 ust. 10b pkt 2 lit. b ustawy o VAT);
  • Brak obowiązku wystawiania zarówno faktury zaliczkowej jak i końcowej, jeżeli zdarzenia miały miejsce w tym samym okresie rozliczeniowym – Zgodnie z obowiązującymi przepisami podatnik jest zobowiązany dokumentować fakturą otrzymane zaliczki jak i dokonane dostawy lub wykonane usługi. Przepisy nie regulują, jak ma postąpić podatnik, który w tym samym miesiącu otrzymał zaliczkę oraz wykonał usługę.

W ramach pakietu SLIM VAT 3 proponuje się wprowadzenie przepisów, które w takich przypadkach będą pozwalały na niewystawienie faktury zaliczkowej (wówczas na fakturze końcowej należałoby wskazać datę otrzymania zaliczki);

  • Rachunek VAT – Zgodnie z przedmiotowym projektem środki zebrane na rachunku VAT będą mogły zostać przeznaczone na uregulowanie zobowiązań w zakresie podatku od kopalin, podatku od sprzedaży detalicznej, opłaty od środków spożywczych (tzw. opłata cukrowa).
  • Brak obowiązku drukowania raportów fiskalnych – Podatnik nie będzie on zobligowany do drukowania raportów fiskalnych ani innych dokumentów niefiskalnych. Przepis ten będzie miał zastosowanie wyłącznie do podatników, którzy ewidencjonują sprzedaż za pomocą kasy rejestrującej on-line lub kas on-line typu wirtualnego;
  • Rozszerzenie zakresu podmiotowego zwolnienia z podatku VAT usług zarządzania funduszami inwestycyjnymi – Na mocy art. 43 ust. 1 pkt 12 lit. a ustawy o VAT obecnie zwolnieniu z VAT podlegają usługi zarządzania funduszami inwestycyjnymi z siedzibą w Polsce. Proponuje się, aby zwolnienie to mogło być stosowane również do usług zarządzania funduszami z siedzibą w innych państwach Unii Europejskiej.
